  • "You", "your" refers to the user or viewer of our website, or the customer booking travel services through us.

  • "Services" refers to any travel arrangements, bookings, or other services provided by Open Reflection.
  • "Booking" refers to the reservation of travel services through our website or directly with our travel consultants.
  • "Travel Supplier" refers to any third-party provider of travel services, including but not limited to airlines, hotels, tour operators, transportation providers, and activity providers.

2. Use of Our Website

2.1 License to Use Website

We grant you a non-exclusive, non-transferable, revocable license to access and use our website strictly in accordance with these Terms and Conditions.

2.2 Prohibited Activities

You agree not to:

  • Use our website in any way that causes, or may cause, damage to the website or impairment of the availability or accessibility of the website
  • Use our website in any way that is unlawful, illegal, fraudulent, or harmful, or in connection with any unlawful, illegal, fraudulent, or harmful purpose or activity

3. Booking and Payment

3.1 Booking Process

When you make a booking with us, you guarantee that you have the authority to accept and do accept on behalf of your party the terms of these conditions. A contract will exist between us once we have issued a confirmation invoice, at which point a deposit or full payment will be required.

3.2 Accuracy of Information

The information you provide during the booking process must be accurate and complete. We reserve the right to cancel your booking if we discover that any information you provided is inaccurate or incomplete.

3.3 Payment Terms

Payment terms vary depending on the type of booking and the terms of our travel suppliers. These will be communicated to you at the time of booking. Generally:

  • A deposit is required at the time of booking
  • Full payment is typically required 60 days before departure
  • For bookings made within 60 days of departure, full payment is usually required at the time of booking
  • Specific payment terms for each booking will be outlined in your booking confirmation

3.4 Payment Methods

We accept payment by credit card, debit card, and bank transfer. By providing your payment details, you confirm that you are authorized to use the payment method and that there are sufficient funds or credit facilities to cover the cost of your booking.

3.5 Price Changes

We reserve the right to change prices listed on our website at any time before you make a booking. After you have made a booking and received a confirmation invoice, the price of your travel arrangements is subject to surcharges only in the following circumstances:

  • Changes in transportation costs, including the cost of fuel
  • Changes in dues, taxes, or fees chargeable for services such as landing taxes or embarkation or disembarkation fees at ports and airports
  • Changes in the exchange rates applied to your package

4. Travel Documents and Requirements

4.1 Travel Documentation

You are responsible for ensuring that you have valid travel documentation, including passports, visas, and any health requirements for all destinations you will visit. Your passport should be valid for at least six months beyond the date of your return home.

4.2 Travel Insurance

We strongly recommend that you purchase comprehensive travel insurance for your trip. Travel insurance should cover trip cancellation, medical emergencies, personal injury, death, lost or damaged baggage, and personal liability.

4.3 Health Requirements

You are responsible for complying with any health requirements or recommendations for your destinations, including vaccinations. We recommend consulting with a travel health professional well in advance of your departure.

5. Changes and Cancellations

5.1 Changes or Cancellations by You

If you wish to change or cancel your booking, you must notify us in writing as soon as possible. Changes and cancellations are subject to the following conditions:

  • Changes may be subject to availability and additional costs
  • Cancellation charges will apply based on how far in advance of your departure date we receive your notice of cancellation
  • The amount of cancellation charges varies depending on when the cancellation is made and the type of travel service booked
  • Some travel arrangements may be non-refundable

Our standard cancellation charges are as follows (unless otherwise specified at the time of booking):

  • More than 60 days before departure: Loss of deposit
  • 59-30 days before departure: 50% of total booking cost
  • 29-15 days before departure: 75% of total booking cost
  • 14 days or less before departure: 100% of total booking cost

5.2 Changes or Cancellations by Us

We reserve the right to make changes to your travel arrangements in certain circumstances. These include:

  • Minor Changes: If we make a minor change to your holiday, we will make reasonable efforts to inform you as soon as possible, but we will not offer compensation.
  • Major Changes: If we make a significant change to your holiday (such as a change of destination or a change to a lower standard accommodation), we will inform you as soon as reasonably possible. You will have the choice of either accepting the change, taking an alternative holiday (with a refund or payment of any price difference), or canceling and receiving a full refund.
  • Cancellation by Us: In the rare event that we must cancel your holiday, you will receive a full refund of all monies paid to us. We will not cancel your travel arrangements less than 60 days before departure, except for reasons of force majeure or failure by you to pay the final balance.

5.3 Force Majeure

We will not be liable for any failure to perform our obligations due to unusual and unforeseeable circumstances beyond our control, the consequences of which could not have been avoided even with all due care. These include, but are not limited to, war, riot, civil strife, terrorist activity, industrial dispute, natural or nuclear disaster, fire, adverse weather conditions, epidemics, pandemics, and technical problems with transportation.

6. Our Liability to You

6.1 Scope of Liability

We will accept responsibility for the arrangements we have agreed to provide or arrange for you as an "organizer" under the Package Travel and Linked Travel Arrangements Regulations 2018, as applicable. Subject to these Terms and Conditions, if we or our suppliers negligently perform or arrange those services, and we don't remedy or resolve your complaint within a reasonable period, we will pay you reasonable compensation.

6.2 Limitations of Liability

Our liability will be limited in the following circumstances:

  • Where international conventions limit the extent of, or the conditions under which, compensation can be claimed for death, injury, or delay to passengers and loss, damage, and delay to luggage
  • When services or facilities are not part of your contracted holiday arrangements and we have acted only as a booking agent
  • When any failure is due to your own actions, the actions of a third party unconnected with the provision of the travel arrangements, or due to unusual and unforeseeable circumstances beyond our control

6.3 Maximum Liability

Except in cases involving death, injury, or illness, our maximum liability to you is limited to three times the cost of your travel arrangements.

6.4 Excursions and Activities

We are not responsible for the provision of excursions or activities not included in your travel package, even if such excursions are referred to in our brochures, website, or by our staff. Where we recommend specific excursions or activities, we do so in good faith, but we do not take responsibility for their provision or operation.

7. Your Behavior

You are expected to behave responsibly and with consideration for others throughout your travels. If in our reasonable opinion or in the opinion of any other person in authority, you behave in such a way as to cause or be likely to cause danger, upset, or distress to any third party or damage to property, we reserve the right to terminate your travel arrangements without notice.

In this situation, our responsibilities to you will cease and you will be required to leave your accommodation or other service immediately. We will have no further obligations to you and will not be liable for any expenses incurred by you as a result.

8. Complaints

If you have a problem during your holiday, please inform the relevant supplier (e.g., hotel, tour guide) and our local representative immediately. If your complaint is not resolved locally, please follow this up within 28 days of your return home by writing to our Customer Services Department at the address provided below, giving your booking reference and all other relevant information. If you fail to follow this procedure, we will have been deprived of the opportunity to investigate and rectify your complaint and this may affect your rights under this contract.

9. Intellectual Property Rights

9.1 Ownership

All intellectual property rights, including copyright, in our website and its content belong to us or our licensors. All rights are reserved.

9.2 Restrictions

You may view, download, and print pages from our website for your own personal use, subject to the restrictions set out below and elsewhere in these Terms and Conditions.

You must not:

  • Republish material from this website (including republication on another website)
  • Sell, rent, or sub-license material from the website
  • Reproduce, duplicate, copy, or otherwise exploit material on our website for a commercial purpose
  • Edit or otherwise modify any material on the website
